General Terms and Conditions – Boutique Villas

Article 1 – Definitions

The following definitions apply in these terms and conditions:

  • Boutique Villas: The company that mediates on behalf of the landlord in the conclusion of the rental agreement between the landlord and the tenant.
  • Landlord: The legal entity or natural person who makes the holiday home available to the tenant.
  • Tenant: A natural person who rents or intends to rent a holiday home from Boutique Villas’ offerings.
  • Co-tenant: A natural person who rents a holiday home together with the tenant from Boutique Villas’ offerings.
  • Holiday home: The building or accommodation, including all appurtenances, inventory, and rented items.
  • Rental agreement: The agreement between the tenant and the landlord for renting the holiday home.
  • Commission: Boutique Villas mediates between the landlord and tenant and charges a commission from the landlord for this service.
  • In writing: Communication by registered mail and/or email.

Article 2 – General

  1. Boutique Villas is a real estate agency specializing in the vacation rental of holiday homes in Ibiza, Spain. The company is based in Amsterdam and registered with the Chamber of Commerce under registration number 73388564.
  2. Boutique Villas mediates on behalf of the landlord in the conclusion of the rental agreement between the landlord and the tenant. Boutique Villas facilitates bookings for the holiday home and/or additional services.
  3. These terms and conditions apply to all offers, agreements, and services provided by Boutique Villas.
  4. Deviations are only valid if agreed upon in writing.
  5. Boutique Villas reserves the right to amend or supplement these terms and conditions.
  6. Boutique Villas expressly rejects all other general (purchase) conditions unless agreed upon in writing.
  7. Boutique Villas is not a travel agency and accepts no responsibility for flight schedules, cancellations, or delays by airlines.

Article 3 – Reservation and Payment

  1. Boutique Villas only accepts reservations from persons aged 18 or older. Reservations made by minors are invalid.
  2. A reservation must be confirmed in writing by the tenant. The booking is complete once Boutique Villas has received the booking form. The tenant will receive a confirmation once the landlord has approved it.
  3. Within three days of receiving the booking confirmation, the tenant must make a deposit of 30% or 50% of the total rental amount, as determined by Boutique Villas. For reservations made less than six weeks before the arrival date, the total rental amount must be paid within three days.
  4. If the deposit is not received within the specified period, the booking will be automatically canceled, and Boutique Villas reserves the right to re-rent the holiday home.
  5. The Spanish government levies a tourist tax of €2.20 per person per night for individuals aged 16 and older. Boutique Villas will inform the tenant of this in advance if it is not included in the price.

Article 4 – Rental Agreement Between Tenant and Landlord

  1. The rental agreement is concluded between the tenant and the landlord, beyond the control and influence of Boutique Villas, which only facilitates the agreement’s creation.
  2. Both tenant and landlord must agree to the terms before the rental agreement is finalized.
  3. The rental agreement is non-transferable.

Article 5 – The Holiday Home

The tenant declares they are aware of the necessary information about the holiday home. A full description is available via the reservation link.

Article 6 – Services

  1. Boutique Villas acts as an intermediary between the tenant and the landlord.
  2. The services are exclusively for personal and non-commercial use. Using information or services from Boutique Villas’ website for commercial purposes is prohibited.

Article 7 – Obligations of Boutique Villas

  1. One week before arrival, the tenant will receive all necessary information about the holiday home.
  2. Boutique Villas organizes a check-in upon the tenant’s arrival.
  3. Boutique Villas will make every effort to have reported defects repaired as quickly as possible.

Article 8 – Obligations of the Tenant

  1. The tenant must use the holiday home with care and behave as a responsible tenant.
  2. Staying with more people than agreed upon is strictly prohibited.
  3. The tenant must report and compensate for any damage caused by them or co-tenants.
  4. The tenant must grant Boutique Villas or the landlord access to the holiday home for necessary repairs.
  5. The holiday home must be left in good condition upon departure.

Article 9 – Cancellation

Cancellations must be made via email and are subject to the following fees:

  • Up to 42 days before arrival: cancellation costs equal to the deposit amount.
  • 42-28 days before arrival: 60% of the total rental amount.
  • Within 28 days before arrival or in case of no-show: 100% of the rental amount.

Article 10 – Security Deposit

  1. The security deposit must be paid to Boutique Villas by bank transfer.
  2. If the security deposit is not paid, Boutique Villas may deny access to the holiday home.

Article 11 – Conformity, Changes to the Holiday Home, Technical Failures, Accidents, and Pool Use

  1. The description of the holiday home must be accurate and approved by the landlord.
  2. Boutique Villas will inform the tenant of any changes to the holiday home before the rental period.

Article 12 – Liability

  1. Tenants are responsible for damage to the holiday home and its inventory during the rental period.
  2. Boutique Villas accepts no liability for injuries or damages during the stay.

Article 13 – Force Majeure

  1. Boutique Villas is not obliged to fulfill its obligations in cases of force majeure.
  2. Force majeure includes, but is not limited to, internet disruptions, illness, government measures, pandemics, and weather conditions.

Article 14 – Confidentiality

  1. Parties are obliged to maintain confidentiality regarding confidential information obtained in the course of the services.

Article 15 – Additional Information

  1. Check-out must be completed before 10:00 AM unless otherwise agreed.
  2. Private parties are not allowed in the holiday homes!
